I. General
The use of the word "Hostico" throughout these terms and conditions will identify the company S.C. Awesome Projects S.R.L. located in Maramureș, Sighetu Marmației, Str. Mihai Viteazu nr. 8 as the service provider. The services offered by Hostico are aimed at individuals, legal entities, legal institutions, etc., who have the legal capacity to be part of a contractual collaboration. Terms, conditions, and descriptions of the operation of the services offered to which reference is made in this document in the form of external links are an integral part of these Terms and Conditions. Additional terms and conditions, even if known, are not part of this document unless they are expressly introduced and mutually acknowledged.
Hostico is the sole owner of all materials and information available on the Website. Clients or visitors of the Website will be unable to copy, reproduce, distribute, publicly communicate, or retransmit any such material or parts thereof, in any form and by any means.
Hostico reserves the right to suspend the services offered in case of violation of the provisions below or in the absence of a timely response regarding these violations. Hostico also reserves the right to disclose customer information in accordance with the Privacy Policy to meet any legal requirements. In the event that this disclosure does not need to remain confidential, the customer will be notified in this regard.
Hostico reserves the right to delete any account with a 15-day notice. Any term not stated in this document is open to interpretation and change by Hostico without prior notice.
II. Contracting
Acceptance in advance of these Terms and Conditions is necessary for any endeavor regarding the purchase of services offered by Hostico. At the moment of placing an order, the client assumes the initiation of a contractual collaboration with Hostico. We will instantaneously confirm this initiation, but this confirmation does not represent an obligation for the client or Hostico to proceed with the activation of the order. We reserve the right to accept or refuse a client's order after examining the authenticity and the level of trust presented by the client regarding the order.
By placing an order, the client declares and guarantees on their own responsibility that they have the legal capacity to purchase the services offered by Hostico for themselves or for the company they represent.
They are obliged to fill in all fields regarding their identification with correct and valid data, which are necessary for the collaboration with Hostico. The client is aware that providing incorrect or incomplete information may affect Hostico's ability to provide the contracted services and, in certain situations, may lead to the refusal of activation of these services by Hostico. The data entered by the client is processed and managed according to the Privacy Policy as well as the Data Processing Agreement.
III. Applicability
The present provisions apply to all Hostico customers, holders of any of the packages or services offered on the website, with the use of the services provided taking place only under these Terms and Conditions, which apply to all contractual relationships between the client and Hostico. The law under which these terms and conditions operate is the one valid at the time of initiating the collaboration. The services offered by Hostico under the contract are those available on the website Hostico.
Identifying all possible interpretations of these Terms and Conditions, as well as covering all possible situations that may arise, is almost impossible. Therefore, any situation or term that is not directly or indirectly presented or addressed in this document falls under the interpretation of Hostico.
IV. Financial
General
The current rates are those displayed on the Hostico website.
Depending on the chosen service, the billing period may vary. All payments will be made based on the pro forma invoice issued by Hostico. The client agrees to pay for the services in advance for the period during which they are provided.
Regardless of the currency used to display the rates, invoices and payments will be processed in RON at the BNR exchange rate on the invoicing date, according to the applicable legislation.
Shipping
Invoices are sent in electronic format via email as attachments and can be downloaded at any time from the client account. Upon request, they can also be sent with the signature of the authorized personnel on them. In the case that the client requests the invoices to be sent in physical format, the shipping cost will be borne by the client.
Deferral/Suspension/Reactivation
The hosting services offered by Hostico are active by default for 7 days after the due date presented on the pro forma invoice.
The services that Hostico purchases from other providers (e.g., domains, licenses, SSL certificates) can only be extended at the time of payment, having an expiration period equal to the due date on the pro forma invoice.
Customers have the option to request a payment deferral for Hostico's hosting services at any time. The deferral can be granted for a maximum period of 14 days from the due date related to the hosting package. In exceptional cases, following a detailed evaluation of the situation by the Hostico support team, a potential exception may be considered, granting a payment deferral that exceeds 14 days.
Customer accounts that have not paid the service fees no later than 7 days after the due date presented on the pro forma invoice will be automatically suspended in the absence of proof of payment or a request for a postponement.
Proof of payment will result only in the activation/reactivation of the ordered/held services, the fiscal invoice being issued only at the moment when the paid amount is visible in one of Hostico's bank accounts.
Hostico reserves the right to reopen/reactivate accounts only after full payment of all amounts owed by the customer.
Non-payment
Hostico reserves the right to deduct from the validity period of the services paid in advance to compensate for amounts owed by the client for services rendered but not paid.
Compensation through this method will be based on the issued proforma invoices.
Hostico reserves the right to suspend the client's account in the event of non-payment of the invoice by the due date indicated on the issued invoice.
If the non-payment exceeds 30 days, the account along with all existing data on it will be automatically deleted from the server.
Any subsequent request regarding the obtaining or restoration of data on the account at the time of deletion, in the case where a backup still exists for these, will be treated within a minimum of 2 hours of support for shared packages without Reseller rights, respectively 4 hours of support for packages with Reseller rights or VPS.
The additional time required will depend on the type of hosting package as well as the amount of associated data.
The required hours of support necessary for restoration will be determined and communicated to the client following an analysis carried out by Hostico's technical operators.
Upgrade / Downgrade
The client has the possibility to upgrade or downgrade the purchased services at any time. For an upgrade, only the difference between the initial package and the package to which the upgrade is made will be charged for the remaining time paid in advance for the initial package. For a downgrade, the remaining credit can be used to extend the associated service, but we recommend consulting the Hostico team regarding your specific needs before performing these operations.
The credit for a downgrade is calculated only for the whole months paid in advance, in relation to the date of the request for the operation and the next due date.
Upgrade/downgrade operations or transitions to a new offer are performed free of charge only once within a 60-day period. In the case of a new request of this type during that period, Hostico reserves the right to charge for the procedure within the support hours.
Upgrade/downgrade operations that involve account consolidations, regardless of the time frame in which they are performed, will be charged within the purchased support hours.
Upgrade/downgrade operations that involve changing the control panel, carried out at the request made by the client, will be charged within the purchased support hours.
The services for which presentation uses values between a minimum and maximum ('from' - 'up to') have the price displayed for the minimum values. The available values up to the presented maximum can be selected for a fee both during the ordering process and later on.
Money Back
The client has the right to request a refund for the services paid to Hostico at any time, however, their return will be made under the following conditions:
- if the request is made within 30 calendar days from the activation of the order, the customer will be refunded the full amount except in cases that involved data migration from an external provider, in this situation, the amount equivalent to the hours of assistance needed for the transfer will be withheld;
- if the request is made more than 30 calendar days after the customer's order activation, only the amount for the remaining full months paid (in relation to the date of the request of the operation and the next due date) will be refunded;
- If the request has already been made for the domain in question, the client will be refunded only the amount for the remaining full months paid (related to the date of the request for the operation and the next due date);
- if the request has already been made by the client in question, they will only be refunded for the remaining full months paid (in relation to the date of the operation request and the next due date);
- If the client benefits from an offer that includes free services (e.g. domains, licenses, ssl certificates), their value will be deducted from the total amount to be refunded.
Amounts paid will not be refunded for:
- services that are purchased through Hostico in the case of the provision or reservation of these services by Hostico. The services that fall into this category include but are not limited to: domain registration and renewal, software licenses, ssl certificates, etc.;
- the recovery of backup copies related to hosting accounts after their deletion, regardless of the reason that led to their deletion;
- services suspended or terminated as a result of violating these terms and conditions regardless of whether they are detected directly by members of the Hostico team or notified by a third party;
The requested amount will be processed by Hostico within a maximum of 15 working days into the account from which it was paid or into another account indicated by the client;
The return will be confirmed at the time of processing by issuing a corrective invoice representing the equivalent of the amount to be refunded;
The period between the issuance of the correction and the actual entry of the respective amount into the client's account is not under Hostico's control, as it is determined by interbank transfer procedures and periods;
From the amount to be refunded, any sum owed by the client based on unpaid proforma invoices issued for services rendered will be retained.
Rate Changes
We reserve the right to modify at any time the rates applied for the services presented on the site.
In the event that the new rates apply to the current services of the clients, they will be notified at least 30 calendar days before they come into effect.
Regarding the modification of the rates applied for contracting new services, the minimum notification period is at least 7 calendar days.
Services paid in advance will not be affected by the rate changes made except at the time of their renewal.
In the case of rate modifications that also involve configuration changes for the contracted services, these will be transposed to the new configurations with corresponding price values or configurations as close as possible to the existing configurations.
Payment Processing
Depending on the type of client, the payment method, the date of the transaction, and the payment collection date, it may involve an automatic or manual application process. By automatic or manual processing, we refer to the direct involvement of a Hostico sales operator in the processing procedure.
Fiscal invoices for payments made by card will be issued only until the penultimate working day of the month. Payments made in the days following this within the same month will be equivalent to fiscal invoices issued in the following calendar month according to their appearance on the bank statement.
Regardless of the payment processing method or the date of issuance of the fiscal invoice, the paid services will be activated as soon as possible by Hostico after confirmation of payment from the payment processor.
Hostico offers the possibility to save card data on the platforms of partner payment processors.
Thus, the customer can add one or more cards to their client account at any time and use them to pay invoices without needing to go through the entire payment process by entering card details and subsequently confirming the payment.
Additionally, alongside the manual use of the saved card for the invoices of purchased services, it can also be set for recurring payment of one or more services, so that as soon as an invoice is issued for that service, the necessary amount for its renewal will be automatically withdrawn from the corresponding card.
By activating recurring payment, the customer grants Hostico the right to collect or withdraw the respective amount equivalent to the value of the service renewal for which the recurring payment has been activated.
Recurring payments collected and processed are subject to the general rules of Refund policy.
The issuance of proforma invoices is done automatically by Hostico at the time of invoicing the services, based on the contact details and billing information related to the service, data completed and provided by the client.
The information on the proforma invoice (unpaid invoice) can only be modified by the client as long as it is in the proforma stage. Changing this information is no longer possible after the payment has been processed and the fiscal invoice has been issued.
For the information on the proforma invoice to also appear on the fiscal invoice, the payer's details from the transaction, data provided by the bank and the payment processor, must match these. Otherwise, the information on the fiscal invoice will be modified by Hostico so that it corresponds with the payer's details.
It is the client's responsibility to ensure at the time of making the payment that the details from which the payment is to be made match those on the proforma invoice.
In certain situations, if the payer's details differ from those on the proforma invoice, Hostico reserves the right to contact the client for clarification of the situation, regarding the provision of additional information for accurate billing.
Modification of the details on the fiscal invoice is possible with few exceptions, before transmitting them to the national E-Invoice system, and only for the current month, before the accounting situation is submitted.
Credit / Funds
The client has the option to deposit amounts into their account in the form of credit or funds, which will be used by the client for paying future invoices.
The invoice generated for adding credit will be subject to the tax legislation applicable to the client, which determines the application and level of the VAT rate.
The credit added to the client's account will not include the corresponding VAT paid, but when using or applying the credit to pay an invoice, the VAT existing on it will not need to be paid.
The use and application of the amounts will be decided by the client and executed manually, they will not be used or applied automatically.
Credit can be applied to invoices only if its value is equal to or greater than the invoice amount before VAT application. Partial payments, specifically using credit to pay an invoice with a value greater than that of the credit, are not possible.
In the event that one or more of the client's services have been renewed in advance or they have consumed more resources than allocated, Hostico reserves the right to use these amounts for the associated generated invoices.
The financial status of the credit/fund is permanently available in the client account.
When using credit to pay for certain services, according to the applicable legislation, the corresponding proforma invoices will become Service Provision Estimates.
The only moment when a tax invoice related to the credit is issued is at the moment of generating an invoice for adding it.
The minimum amount that can be deposited is €10.00, and the maximum is €1000.00. Also, the total funds available at any given time cannot exceed the amount of €1000.00.
Promotions
In the case of offers with free products/services, these can only be used on Hostico's equipment and network. In the case of transferring services to other providers/registrars, the client will be charged amounts equivalent to the activation of these services. Hostico reserves the right to terminate the validity of a promotional offer at any time.
Regarding the services offered for free or those that are under an active promotion, typically the offers apply only for the first year of use, with the requirement that in the second year the full price of the service must be paid if an extension is desired. Hostico may exempt any services it deems appropriate from this rule for an indefinite period.
The issuance of invoices, as well as the activation or reactivation of the related services, will be carried out during the working hours of the commercial department, except for holidays and legal days off.
In the event of a violation of the presented terms and conditions, Hostico reserves the right to block refunds to the client.
Promotional Coupons
Promotional coupons are structured into several categories based on validity period, possible number of uses, and the launch date. This page will display available promotional coupons at regular intervals along with the hosting packages/services and the periods to which they apply.
- Weekly Coupons
Every week from Monday to Sunday, a hosting package will be randomly chosen to benefit from a promotional coupon. The amount of the discount and the minimum purchase period will vary weekly, thus directly offering the opportunity to choose the right package at a reduced rate.
- Flash Coupons
These coupons will be valid for only 24 hours, however, the short validity period will be compensated by the higher percentage of the discount compared to the other coupons.
- Monthly Coupons
Due to the fact that not all of us have the necessary resources to identify short-lived coupons, we have decided to provide customers with offers on all hosting packages every month. The main factor for this discount will be the billing period and not the chosen package.
- Holiday Coupons
Some holidays deserve to be celebrated! On this occasion, Hostico will offer discount coupons on the entire range of hosting/web services.
- Limited Coupons
Unlike the other coupons presented earlier, these are not limited by a timeframe, but by the number of uses. Each coupon in this category, once exhausted, can no longer be reused.
General terms for using promotional coupons:
- promotional coupons are available to all individuals and legal entities
- the discount will only be applied to new hosting orders
- the activity of the site must comply with the Hostico Terms and Conditions of Use
- coupons cannot be applied retroactively
- coupons cannot be combined with other coupons or other discounts offered by Hostico or third parties
- coupons apply only to the first purchased period
- the coupons apply only to Hostico hosting packages and private servers
- the services/products offered for free in the purchased hosting package are not subject to discount
- coupons do not apply to upgrade orders
V. Domains
Regarding the relationship from the perspective of domain name registration/renewal, our responsibility is limited to providing the service of purchasing/renewing the domain name.
Hostico cannot and will not verify the legality of the domain name registration, the only check carried out by Hostico being the availability of the domain for registration. Checking the chosen domain name for registration concerning the violation of certain laws as well as the violation of intellectual property rights of third parties is the client's responsibility.
Unless otherwise provided either by submitting distinct data via the respective order form or by written communication to Hostico, the registration of domains will take place based on the identification data existing in the client account. The client thus becomes both the rightful owner of the registered domains and legally responsible for them.
The current allocation of the domain is not under the influence or control of Hostico, and the client can be sure that the registration/renewal only took place at the moment this operation was confirmed by us.
Hostico takes no responsibility and does not provide any guarantee regarding the registration/renewal of domains.
Domain extensions are managed by a multitude of different organizations. Each of these organizations has its own terms of registration, management, and dispute. For a registration/renewal to take place successfully, the client will need to provide the information and documents requested by the members of the Hostico team, as well as closely follow their instructions.
Once the domain is registered for a predetermined period of time, it belongs to the client in the form of the chosen string of characters. Changing domain names after the registration or transfer confirmation is not possible.

The payment for domain renewals must be made before the due date related to the proforma invoice, specifically the expiration date, to avoid situations where the domain can no longer be renewed. The dates displayed in the description of the invoice or in its contents do not represent in any case the deadline and should not be considered as a payment deadline. The information in the description is only estimates provided by domain registrars regarding their validity and is included strictly for the general information of the customer.
In the event that the domain is paid after the due/expiration date, Hostico disclaims any responsibility for additional fees charged by the registrar for the reactivation/renewal of the domain.
If the contracted domain is not properly renewed and, as a result, becomes available on the market and is registered by others due to an action or inaction by Hostico or any technical malfunction that may occur, Hostico shall not be held liable for the losses suffered by the user.
In the event that the user suffers losses as a result of the domain being inaccessible for a period of time or being registered by other parties, the compensation granted by Hostico shall not exceed the amount paid initially for the domain, according to the value recorded on the invoice. The finding must be communicated to Hostico in writing within 30 days from the date when the situation was noticed.
Hostico does not assume responsibility for the availability of domain names during the time interval between the order placement and the actual payment for domain registration. The domain registration service operates globally on a "first come, first served" basis.
Registering a domain name does not confer immunity in the event of objections regarding the registration, reservation, or use of that domain name. In the case of a dispute over a domain name, Hostico will put the parties in direct contact to resolve the situation amicably.
If the two parties do not reach a consensus, the dispute can be resolved by resorting to a court of law.
Throughout the course of the amicable or judicial dispute, the client will uphold Hostico's innocence and will accept that Hostico can take any measures deemed necessary to protect its interests, including but not limited to blocking, deleting, or transferring the domain.
Due to the way the Hostico DNS service operates for shared packages through the DNS cluster, there cannot be 2 domains with the same name on Hostico servers. This situation may pose a problem if there is a record of an expired domain on Hostico DNS servers and a third party places an order for hosting the respective domain name. In this case, in order to honor the placed order, Hostico will contact the owner of the expired domain's hosting to delete its DNS record. If the client does not respond to this request, Hostico reserves the right to delete the DNS record of the domain from its servers. This action does not affect in any way the information stored regarding the domain (website, mail, databases).
VI. Liability
Hostico cannot be held responsible for damages caused by the temporary unavailability of equipment or the network, regardless of the reason for this interruption.
This provision also includes damages resulting from the deterioration or loss of data.
The client agrees to guarantee and hold us harmless in connection with any claims, damages, including, but not limited to, damages caused to third parties, resulting as a consequence of the use of the services causing harm to our client.
Hostico reserves the right to perform short maintenance operations (5-10 minutes) at any time of the day in order to implement measures aimed at improving the characteristics (performance, security, reliability, etc.) of the services offered. These operations may be carried out without prior notification to the affected clients.
Hostico assumes responsibility in the event that the interruption of service provision was caused intentionally or is the result of negligence on the part of the Hostico team. The client declares that they understand and agree that the total amount of damages claimed by them for any reason from Hostico, and that could be paid by Hostico, shall not exceed in any way and in any case, the total amount of fees paid by the client to the provider on the last invoice for the provision of services for which damages are requested.
The client assumes responsibility for any damages caused to Hostico directly or indirectly, through the improper use of the services provided, and the violation of these terms and conditions. This includes but is not limited to legal fees, attorney fees, notary fees, and any other expenses.
Hostico provides through its website tutorials, configuration examples, and answers regarding various aspects of the operation of certain services, applications, operating systems, control panels, etc. All the information in these articles has been tested and deemed valid at the time of their publication, based on the operational modes at that time, the versions of the applications available at that time, and the existing documentation. Hostico does not guarantee the achievement of the functionality presented or desired as a result of the steps outlined in the articles at a later date, on different configurations, and on other versions of the applications, and therefore does not assume responsibility for any damages that may result from the application of the information presented in the articles, regardless of their type.
The client account management application for services offers the functionality of transferring services held to another Hostico client account. This transfer requires access to the holder's client account, as it can only be initiated from there and to the email associated with the client account for transfer confirmation. As a result of the imposed security measures, Hostico does not assume responsibility for the transfers made. The owner of the service is the client who holds the service in their account at the time of any requests for information or actions regarding that service.
Hostico is not and cannot be held responsible for the resolution of bugs or incidents during interventions on the applications used in the situation where the manufacturers/suppliers of those applications do not have a solution available for remedying these bugs or they cease to provide technical support.
Hostico does not assume responsibility regarding the licensing of software products used by the Client, other than those provided by Hostico.
VII. Data Integrity
In the case of Shared hosting accounts and Servers managed by us, we are responsible for the server's security but not for the applications installed by the client.
Hostico does not assume responsibility for existing security breaches in the client's applications and for any damages caused by their exploitation.
Responsibility in this regard lies with the administrator, namely the application developer.
Hostico does not assume responsibility for the protection of personal electronic devices used to access the contracted accounts/services. It is the user's responsibility to ensure that both the applications installed/used on the hosting accounts and their own devices are updated and secured.
The client will have access to accounts through a combination of username and password. They are responsible for keeping this information and other sensitive details secure.
The client will be held liable for any abuse resulting from the authorized or unauthorized use of this information. If they become aware that an unauthorized third party knows this information, they must reset it immediately.
The description of the conditions under which backups are made and kept is available at Hostico backup.
However, it must be noted that we do not provide any guarantee for the integrity of the backup copies, and the sole responsibility for the existence of a backup copy of the data rests with the owner of that data.
VIII. Support / Assistance
Identification
The support for the services offered is available through the methods and during the time frame presented on the contact page regardless of the type of service contracted.
Depending on the information and/or operations requested, Hostico operators may proceed to identify the customer as the holder of the services that are the subject of their requests.
Identification methods vary depending on the contact method used by the customer as follows:
- telephone - request for information in the customer account as well as the support PIN
- chat - logging into the client account
- respective email and ticket - using the mailbox associated with the client account for submitting requests
Failure to comply with Hostico's requests hinders the identification of ownership rights and will result in the inability to respond to the submitted requests.
Response time
Hostico tries to provide a response time of under 60 minutes for requests sent via email or ticket. However, this time may be influenced by the complexity of the actual issue as well as the number of existing requests at that moment.
Phone communication, as well as through the support application, although it takes place in real-time, does not guarantee an immediate resolution of the presented situation.
Phone Support
Phone support cannot be used as a method for investigating or troubleshooting situations in real time.
Any request that requires an investigation time longer than 5 minutes will be directed to alternative support channels.
Hostico reserves the right to interrupt the support provided in relation to a client in exceptional cases, such as:
- abuse of support requests
- indecent language and behavior of any kind towards Hostico team members
Classifying requests as abusive or language, behavior as indecent, insulting is the prerogative of Hostico.
Any request that falls outside the scope of assistance provided by Hostico within VPS Managed and Shared Hosting will be addressed through the respective support hours of the Managed Hosting service.
These requests include but are not limited to:
- device and mail client configurations
- assistance with installed applications
- any other request outside the scope of standard Hostico support
Clients who provide Hostico services to third parties are responsible for managing the services offered to that third party and ensuring the necessary technical support.
Hostico will not provide technical support to those third parties in these situations in the absence of the ability to identify and determine the nature of the relationship between the Hostico client and the third party.
VPS Hosting
Hostico's responsibility within the VPS services is limited to the operation and ensuring Internet connectivity of these services. Services installed on the VPS are not covered by Hostico unless the Managed VPS service is purchased.
Except for offers or promotions where support is specified as free within the VPS services, support is not included for free.
Customers who wish to perform operations outside the standard support services can purchase support hours.
Hostico reserves the right to refuse the installation of new applications, services, libraries even within the purchased support/administration hours.
Managed VPS
The VPS management service is available only for VPS purchased together with a control panel available in the Hostico offer.
Within the managed service, the client will not have access to super user authentication credentials at the server level.
Administration refers to and consists of the services and applications necessary for the functioning of a standard hosting server provided by the installed control panel.
Among these, we list: web server, mail server, database server, control panel, ftp server, programming languages necessary for running client applications.
Any requests regarding the installation or configuration of external services and applications to these and the control panel will be subject to and handled within the purchased support hours.
Server management by Hostico includes the following operations:
- installation and configuration of the control panel with its related services
- firewall installation and configuration
- periodic update of installed services
- 24/7 monitoring and intervention
- service-level optimizations
- server-level automations
Unmanaged / IaaS
Holders of IaaS services will receive free assistance only regarding the operation of the purchased services and their interconnection at the infrastructure level.
VPS configurations, networks, external storage, etc. are not included in this.
The transition to Managed VPS is only possible with the purchase of a new VPS with that option.
Holders of these services can benefit from additional technical support only by purchasing support hours.
Customers with self-managed VPSs will be notified if the VPS is identified as being infected or compromised due to activity conducted on the network or as a result of the triggering of other indicators monitored by Hostico.
Depending on the severity of the situation and the activity of the VPS, various measures will be taken after contacting the customer, such as: disconnecting connectivity to the public network, stopping the VPS, etc.
Customers are responsible for identifying and removing the source of the compromise as well as the utilities used by attackers from the VPS to restore it to operation, and/or may opt to contract a new VPS to restore the valid data they hold.
If the customer does not intervene, does not take responsibility, and the problematic activity of the VPS does not cease, Hostico reserves the right to suspend its operation indefinitely.
Shared Hosting
Shared hosting package clients benefit from 24/7 assistance regarding the operation and functionality of the services installed on the server. Requests made outside this scope can be classified and offered either within other Hostico services or within the purchased support hours.
At the shared server level, no changes that would affect the operation of the services or the server for other clients on that server will be implemented.
Holders of shared hosting services can opt to purchase support hours for performing operations not included in the standard support.
Managed Hosting / xCMS
Customers who need assistance with performing various operations within the applications they have installed can contract the xCMS service.

Reseller Hosting
Just like Shared Hosting service holders, clients with Reseller packages benefit from 24/7 support regarding the functionality of the services offered.
Data Migration
The transfer of customer data is an operation carried out by the Hostico team as long as the destination server is part of the Hostico network and the operation does not fall under the jurisdiction of other clauses in these terms and conditions.
This operation does not involve any cost in the following cases:
- based on the initial order of a respective service package within the Shared Hosting, Reseller, and Managed VPS services
- between the servers in the Hostico network as a result of an Upgrade / Downgrade operation except for the one specified in the description of these operations
The operation will be charged during support hours in the following cases:
- transfer to VPSs under client management
- data transfers requested within 30 days of activating the Hostico service for accounts / sites / applications different from the main service to which the transfer is being made
- If, due to an action / inaction of the client contrary to Hostico's instructions, the data transfer must be resumed
- Any operation that cannot be performed by automated means and requires manual or customized intervention.
Due to the multiple possible combinations of settings, both for the application and for the programming language, we cannot provide an absolute guarantee and do not assume responsibility for the optimal functioning of the site/application following a package change, migration, or application cloning. Each user may have their own configurations, which can influence performance and compatibility with specific devices and environments. The client must ensure that the data has been migrated as requested, and in the case of email accounts, the user is responsible for configuring/reconfiguring the email clients they use.
Hostico cannot be held responsible for any operational errors or difficulties in accessing certain functionalities that may arise from migration between different servers, both at the level of the website/application and for the email accounts.
Support Hours
Support hours represent the time allocated for client requests over the course of a month. These are divided into 2 categories, namely:
- support hours provided by default within the purchased services
- additional support hours, purchased for carrying out tasks outside of standard support
The major difference among these is given by the validity period and the possibility of accumulation.
The support hours offered implicitly are only valid for monthly periods, expiring at the end of each paid hosting month and cannot be accumulated with those from the next month.
Support hours purchased directly can be combined with other support hours and do not expire.
The purchase of support hours does not guarantee the assumption or resolution of requests submitted to the Hostico team.
The counting of support hours at the level of requests submitted to the technical team will be done based on the time allocated for problem-solving by the Hostico technical operator.
Support hours will be counted for all technical requests made within the VPS Managed services, regardless of the method of contact, with counting taking place for both direct requests made by the account holder and for any third parties granted the right to make technical requests.
By non-standard support operations, we understand any action that can be performed directly by the client (with or without the guidance of Hostico's support team), but for various reasons, it is requested to be carried out by the technical operators.
IX. Reseller plan rules / VPS plan
The client has the right to their own contractual relationships based on the online presence provided by Hostico. In this case, the client remains from our point of view the primary contractual partner. The client is obliged to pass on the terms and conditions set forth in this document to all third parties they engage with and to ensure that they understand, accept, and comply with them.
In the case of changes that need to be made to the reseller's clients / VPS holder, they are obliged to cooperate. Upon request, they must provide us with the contact details of their clients. Hostico reserves the right to directly request written confirmation for any changes that need to be made regarding the reseller's clients / VPS holder.
The reseller / VPS owner is responsible for any violations of the terms and conditions made by their own clients. This includes financial liability for any damages caused as a result of these violations.
The reseller / VPS owner agrees to indemnify Hostico from all claims that may arise from third parties and other contractual partners of theirs.
X. Content Policy
The services offered by Hostico give you the freedom to upload, deploy, and utilize applications for both personal and commercial use.
The use of various applications through Hostico's services is subject to the Terms and Conditions of those applications.
It is the client's responsibility to identify their own information and that belonging to other individuals, legal entities, and any other entities.
Compliance with and adherence to copyright, trademarks, and other types of intellectual property are the responsibility of the client; therefore, the client agrees not to publish content that may infringe on the rights of third parties or applicable laws.
The Hostico equipment and network may only be used for legal purposes.
The transmission, storage, or distribution of any information, data, or materials that violate current legal provisions or that, directly or indirectly, may facilitate the violation of any legal provision is prohibited.
Under no circumstances and by no means will the services offered by Hostico be used for the communication of, reference to, or direction towards any of the following.
- materials or informational content that infringes copyright, trademark rights, as well as any other intellectual property rights belonging to a third party
- nudity, pornography, any image or text with sexual or obscene content, without complying with the applicable legal conditions
- child pornography
- threats, abuse, harassment, defamatory statements
- any image or text intended to encourage xenophobia;
- text or materials of a violent nature
- defamatory, insulting, disparaging, or slanderous content
- content with racial or discriminatory character
- content that is deceptive, false, misleading, or fraudulent
- content that invades the privacy of a third party or violates their legal rights
- vulgar, obscene, indecent or illegal content
- viruses, trojan horses or other similar
- pirated software or software targeting those who pirate software or engage in any similar activities
The client agrees to respond to Hostico's requests regarding complaints made by third parties concerning the content of the website within 5 days of receiving the notification via email. Hostico is not obliged to verify or review the content published by clients.
Hostico reserves the right to remove or modify at its discretion any client content that is determined to violate these terms and conditions with prior notice.
Hostico reserves the right to suspend the account of any client who violates these provisions without any prior notice.
In the event that the client collects/processes personal data, it is their responsibility to ensure that this collection/processing is in compliance with the applicable legislation.
XI. Usage Policy
This policy is necessary to protect the quality of the hosting service.
We want to meet the requirements of all our clients by providing quality services, an objective that can also be achieved with the client's support.
The way the client uses the services provided by Hostico is closely related to the proper functioning of the equipment and the network, making it necessary to ensure an appropriate environment for providing hosting facilities.
We do not allow the use of programs that run continuously in the background.
We do not allow scripts to be run by cron jobs set at intervals shorter than 5 minutes.
We do not allow the use of CGI scripts.
The following activities are prohibited:
- using Hostico services for the creation or transmission of computer viruses, worms, flooding, mail bombing, or engaging in denial of service attacks
- the use of scripts for proxy or IRC, or types like FormMail, PhpShell or other similar ones, including commercial scripts that contain known security vulnerabilities, chat rooms, wap chats; IRC Egg Drop bots, torrent trackers, etc., top sites, online games (except flash ones)
- collecting personal information for illegal purposes
- unauthorized access to data, systems, or networks (phishing, spoofing, proxy, hacking, sniffing, etc.), including any attempt to probe, scan, or test the vulnerability of the system or network or to create security breaches without the authorization of the network or system owner
- any intervention on the service provided to a user, on a server or network such as: mail bombing, flooding, deliberate actions to overload the system
- TCP-IP packet spoofing
- to upload infected, corrupted files or any other software or similar application that could harm a third party
- to restrict or prevent any other user from using Hostico services
- to collect or gather information or email addresses of third parties without their consent
Any attempt to harm servers or customers is strictly prohibited. Any activity that affects the proper functioning of the server will be considered abuse and will be regarded as an attempt to harm other colocated customers.
Any script that poses a potential security risk or may affect the performance of the servers or the security of the network will be automatically closed or removed without prior notice.
Hostico reserves the right to act quickly to remove, block, or reset access to any account, application, activity, or information that by its nature may affect the operation of the respective equipment of the Hostico network or may harm the rights of a third party.
In order to ensure the proper functioning of electronic messaging, the following provisions must be taken into account by the client.
According to legal regulations, it is prohibited to conduct commercial communications via electronic mail, except in cases where the recipient has expressly given prior consent to receive such communications.
Email lists / Newsletter
Mailing lists can be operated under conditions where individuals give their explicit consent in this regard, consent that must be recorded by the list operator and kept for the entire lifespan of the mailing list.
Hostico requires that any commercial email or as part of a mailing list includes simple and visible "double opt in/double opt out" options.
Sending bulk emails consumes server resources, and this action negatively impacts the quality of services received by the client; therefore, we have some recommendations in this regard:
- the sending should be done early in the morning (by 09:00) or in the evening after 22:00
- the sending should be limited to a few dozen emails/minute
Non-compliance with these recommendations may lead to:
- the email server congestion due to a very high volume of requests, sometimes resulting in the mail server being blocked
- blacklisting the IP address from which the sending is made in multiple spam lists, with repercussions for all clients hosting applications on the server in question
- very low ranking in terms of email services such as Yahoo, Gmail, etc
- large delay in email transmission
- delivery to other email servers may become impossible
- affecting all clients connected to the network due to the improper functioning of the servers.
Hostico does not limit the number of emails that can be sent per hour but monitors SMTP traffic and reserves the right to intervene, including by deleting sent messages and contacting the client in case we believe that a certain sending does not fit within the volume of the purchased service package or harms the functioning of the server.
In case the client has a mailing list, it is recommended to contact Hostico to establish good sending practices and to fit into an optimal service package.
The limit for an attachment is 25MB. The maximum number of recipients for a message is 25.
We do not recommend / allow sending to a larger number of CC/BCC recipients because if a single address among the recipients is incorrect/non-functional, the entire message will remain blocked on the server.
To prevent any negative effects regarding the functioning of the services, Hostico reserves the right to limit certain parameters of the email service offered to clients at any time.
Anti Spam Policy
The sending of unsolicited commercial messages (SPAM) to promote any site using our servers or through third-party servers to promote any site or application hosted on the Hostico network will result in the suspension or cancellation of the client's hosting account, without any prior notification.
Hostico does not allow the use of its services directly or indirectly for sending, transmitting, handling or delivering email messages:
- unsolicited (spam) in violation of any existing laws in this regard
- to email addresses obtained through harvesting methods
- to addresses that are incomplete or inaccurate
- that do not comply with the best practices in the industry
- to purchased, rented or borrowed lists
- to lists that will generate a high number of SPAM complaints
- to addresses that will lead to the IP being listed in blacklists
- that use or contain spoofed headers
- that use or contain non-existent domain names
- that hide or try to complicate the discovery of the origin point of the transmission
- that use other misleading addressing methods
- that use the domain name of a third party without their consent
- sent through a third-party server without their consent
- that contain false or misleading information
The Client commits to responding to Hostico's requests regarding complaints made by third parties concerning their activities within 5 days from the notification.
Hostico reserves the right to request at any time evidence regarding the consent given by the subscriber to the list operator concerning the sending of messages.
Hostico reserves the right to ask the list operator for the methods of subscription/unsubscription presented to the subscribers.
Hostico reserves the right to suspend the account activity if these provisions are not complied with.
Email sending / receiving
Hostico cannot guarantee the delivery of emails sent from its equipment and network to the recipients' Inbox.
Hostico also cannot guarantee the delivery of emails regardless of the sender/recipient's location (internal/external to the Hostico network).
The sending and receiving of an email can be affected by several internal or external factors, among which we enumerate:
- mailboxes without available space that can no longer receive messages
- Sender IPs included in various blacklists whose connection to the destination mail server is blocked
- malfunctions regarding sending/receiving mail servers
- malfunctions at the internal/external network level
- mail servers with aggressive spam filters
- email content considered spam by the sender/recipient server
- attachments that exceed the size limits accepted by the sender/recipient mail server
- temporary rejections of email messages due to greylisting policies
- etc.
Dedicated IP
The status of dedicated IPs allocated to clients is checked in advance before the actual allocation.
The verification includes but is not limited to: the status of the IP in various blacklists, its reputation, etc.
Therefore, any subsequent change of the IP will be made only for well-founded reasons. The request to change an IP may be refused or charged if the actions taken by the client have affected the status or the reputation of the IP.
Changing the dedicated IP will involve a one-time fee of 10€
The Dedicated IP services include a single Dedicated IP that will be allocated to all domains, subdomains, and accounts running under that service. In case of wanting to separate some domains, subdomains, and accounts onto other dedicated IPs, a separate purchase of these is necessary.
The allocation of IPv6 (where possible) is done in parallel with the allocation of IPv4 because they do not exclude each other. The provided service will work simultaneously on both IPv4 and IPv6. At the customer's request, the IPv6 address can be removed.
XII. Resources
Each shared hosting account has its own resources based on the type of package purchased. A detailed list of these resources can be seen by accessing the resource usage page.
All accounts are monitored to track their resource consumption.
Hostico reserves the right to contact the client regarding an upgrade of the held package or with performance improvement suggestions if one or all resources of the held hosting account are frequently used to their maximum capacity.
Files larger than 500 MB cannot be stored on shared hosting accounts, except for the backup of the account.
Hostico services cannot be used for audio streaming, video, file sharing, or image sharing.
The use of our servers as storage (e.g., movies, mp3, pictures, archives, software kits, etc.) is also prohibited.
Hostico reserves the right to suspend applications or accounts whose activity hinders or affects in any way the proper functioning of the server without prior notice.
The Reseller plan allows the creation/adding of up to 10 hosting accounts for free, including the reseller's own account. Customers who wish to create/add a larger number of accounts have the option to purchase limits above the default ones.
In the case of VPSs managed by Hostico, the license of the control panel installed on the VPS may impose a limitation on the number of accounts and/or domains that can be created under that particular license. This limitation can be modified and/or removed at any time by performing a downgrade/upgrade of the corresponding control panel license.
The space offered by VPS packages represents the total value allocated to the server, but not the value that the client will directly benefit from for their data (website files, databases, emails).
A part of the total allocated space will be occupied/used by the operating system installed on the VPS as well as by any potential control panel. The space directly available for the client's data being reduced.
A part of this space must also always be available for the possibility of updating the operating system and other applications installed on it.
Holders of VPSs managed by Hostico will be automatically notified when the available resources on the VPS start to approach a critical level so that they can take the necessary measures.
In the event that the client does not take any action to increase the available storage space and it falls below 1% or 1GB, Hostico reserves the right to suspend the operation of the VPS to protect against data corruption on it.
For the presentation of the extensive capacity of the features offered by the services, in some situations, words such as "Unlimited" and/or "Unmetered" may be used to describe them.
These words refer to the ability to utilize a high amount of resources and not the possibility of unrestricted use of those resources, more specifically without the existence of an upper limit associated with them.
These thresholds regarding the resources that can be created or added (mailboxes, subdomains, parked domains, completion domains, etc.) are set at the number (quantity) 999.
Regarding the threshold for monthly traffic, it is determined by the bandwidth allocated to the contracted service, at a constant speed of XMb/s (bandwidth/second) with the possibility of not exceeding a traffic of X*S/Monthly (bandwidth/second * number of seconds corresponding to the month).
Resource Usage
Shared VPS
In the case of VPS with shared resources, their maximum usage on a constant basis is prohibited.
Hostico will monitor resource consumption and will notify the client in cases where consumption exceeds the following thresholds:
- CPU 100% for periods longer than 30 minutes
The client will have the option either to identify and resolve the situation that has arisen or to migrate to a Dedicated VPS. Hostico reserves the right to suspend the operation of the VPS if its processes affect the proper functioning of other VPSs on the VPS node or in the case of ignoring multiple notifications sent in this regard.
Dedicated VPS
The resources allocated for these types of VPS are 100% dedicated.
Their usage can therefore be carried out at maximum levels for longer periods.
XIII. Validity
This document is valid for an indefinite period.
Hostico reserves the right to make changes to this document, which is why clients are encouraged to consult it periodically.
